The employee’s right to stable working conditions.
If the employee has worked for at least 6 months, the employee will have the right to ask the employer to change the contract for an indefinite period or to hire him full-time. The employee’s application may be rejected at the will of the employer, but the employee’s application for stable working conditions cannot be refused. The employer will be required to respond to the request in writing or electronically, and in the event of refusal to justify the decision.

Parallel work.
After the new regulations enter into force, the employer will not be able to prohibit the employee from being in an employment relationship with another employer at the same time, and the employee cannot be discriminated on this basis. The employment contract cannot contain provisions stating that the employee may not take up additional employment or restricting this employment. Limitation of possible additional employment will be possible only on the basis of a separate non-competition agreement, non-competition agreement or when separate regulations allow for limiting the employee’s employment.
Yesterday, partners of our law firm, Lidia Blaszka-Griffin and Jakub Stempski, took part in the 5th Polish Development Congress. We had the opportunity to talk about today’s challenges that are faced both by the development industry and cities’ mayors, and also to meet with the lawyers operating in the industry. The congress was dominated by topics related to the upcoming market cooling and the related uncertainty. Participants discussed in panels devoted to, inter alia, public transport, financing of development investments, the lex developer act and spatial planning reform. The culmination of the event was the evening gala in which we participated, and at which the annual ranking of cities was presented. The event was graced by a concert by the excellent Małgorzata Ostrowska. We would like to thank the Polish Association of Developers for the opportunity to participate in the Congress and see you at the next congress.
In August this year, significant changes to the Labor Code were to enter into force, implementing EU directives on parenthood and transparent working conditions. Due to the delay in legislative work in the Polish parliament, the implementation of these changes has been postponed. As of today, the government plans to enter into force of the new regulations from January 1, 2023. Poland had 3 years to implement these changes – the original implementation date expired at the beginning of August 2022. Today in Warsaw, at the National Convention of Attorneys at Law, votes are being held on regulatory changes for the operation of the attorneys’ profession. Law firm partner Lidia Blaszka, who holds the position of national delegate on behalf of the District Chamber of Legal Advisors in Poznan, will attend the votes on the changes. The proposed changes include the Code of Ethics for Attorneys at Law, which would clarify relationships with clients and how to obtain them. The convention itself is an opportunity to meet with attorneys from all over Poland to share and discuss experience.
